Can I ask you to edit art purchased?

• Unless we made a mistake we do not edit finished artwork without additional charge. This includes adoptables.
  
• If you'd like us to edit our work we will ask for additional fees and have right to decline if requested.

Who draws most of the adopts/art?

• A majority of adopts are collaborations. Thus both of us work on one piece. Not split up the adoptables in a batch as we have lots of art styles, and our styles are different.
  
• We sometimes note who does what in the artwork or if its drawn solely by one person.
  

My Commission isn't finished; why do you open slots or sell more adoptables?

• Because there's two of us, one partner may finish and/or have free time while waiting on other. (One is faster than other)
  
• Also we have adopt weekly schedule, we work on along side commission, and it is our goal to always meet this schedule to be consistently active to our watchers and buyers and especially to our patrons who support us and see these consistently.
  
• If commissioner not comfortable seeing adoptables or art being released regularly while waiting their turn for the finished commission from us, please don't order >.<"
  
• Besides commissions and customs listed on our account, we may have work elsewhere listed on our individual account.

Can you lower the price of the adopt so I can buy, or give me unsold adopts for free?
 Aren’t your prices too expensive?  Maybe lower your prices a bit so that it’s more accessible? I really want you to draw for me but I can’t afford these prices…

• No, we typically never lower any of our adopts or give an unsold ones for free.
  
• If you can't afford, don't buy from me. Please save up and purchase our works instead.
• They are all up for sale if they are open. DO NOT ASK IF ITS FOR FREE because it's not.

Can you give me advice on how to sell adoptables / interest in my art?

• Sorry. What we do may not work for every artist/adoptmaker so don't want to give out bad advice.... , but artist should get to know their own customers! They don't bite hopefully.

 Can I give a suggestion, critique, criticism, and/or advice to you?

• Please don't, unless we specifically ask and request of such.
• We have designated areas where we accept suggestions such as polls or journals, as we want to be able to keep track of suggestions and be able to refer them.

We do get random suggestions from time to time.
We do want to keep track of suggestions, so we will keep this journal open to suggestions or ideas you guys have in mind, and redirect people to this journal.
These are suggestions, and thus it's possible we will not do them.
If you want us to do your idea, then please order a custom or commission from us.

• Unsolicited (not asked for; uninvited, unrequested) suggestions, critiques, criticism, and advice are not welcomed.
• Criticism is never welcomed.
• Despite some having good intentions, it is not fair for us for others to expect us to remember every random suggestion/advice/critiques given.

Communication

• Please fill out the commission form when requesting a commission if commissions are available.
• If by any chance you would like to contact us through a different method such as e-mail or another website, please discuss with us, so we can arrange a convenient method.
  

Concerning Commissions, we will contact you...

• If we need additional information regarding your commission/adoptable and/or payment.
• To confirm receipt of your commission form or adoptable purchase
  
• If there will be a delay in the commission/ adopt delivery
  
• When we have a WIP to provide you if you requested WIP of commission is not given unless asked by Commissioner or else the final product will be only delivered
• Revisions can only be asked for upon delivery of WIP once.

• If we have to cancel your commission for any reason.
• To deliver the final product
• Unless the artist makes a mistake, revisions will not be made free of charge and will require additional fees
• The final product will be in digital format PNG or JPEG and will not be delivered physically. 
  

Concerning Adoptables, we will contact you...

• If we need additional information regarding your adoptable or payment.
• To confirm receipt of your adoptable purchase
  
• If there will be a delay in the adoptable delivery
• If we have to cancel your adoptable purchase for any reason.
• To deliver the adoptable
• Revisions or Edits will not be made free of charge and will require additional fees
• The final product will be in digital format PNG and unwatermarked, and will not be delivered physically. 
• If buyer or another individual has infringed on our terms and concerns you.

You may contact us..

• To request a progress update
• To discuss additional information
• To change or update your commission information.
• To confirm payment or discuss payment
• To notify us of new Adoptable Owner or transferring of ownership of an adoptable.
• To request a hold or offer a price/bid on an adoptable.
  
• We only do holds for the allotted payment period designated on the adoptable's description. Anything longer than listed can only be requested by a frequent adopt buyer/customer of ours.
  
• We do not do holds if you plan to pay with points

Pricing

• Certain options may be slightly more or less expensive for various reasons.
  
• Base prices and expected turnaround are listed
  
• Additional charges may be made depending on your request, and may also affect the turnaround time.
• We will not charge for extra time if there is a delay with your commission or if otherwise take longer than expected.

Payment

• We reserve the right to withhold any completed commission, adoptable, or work in progress preview until the full payment is received.
• Please do not send any amount of money directly to our Paypal or points to RumCandyAdopt account unless explicitly instructed to.
• If under any circumstances the buyer cannot pay the full amount upfront, please discuss with us, so we can negotiate.
• We highly suggest buyers not to AB, bid, or purchase adoptables or commissions if they do not have money on hand.
  
• This is also if you are interested in paying in installment.
• We will not under any circumstances give the unwatermarked full-res version until full payment has been given.
• We will not give lineart of premade adoptables to adopt buyers, as premade adoptable buyers only receive what they have won as listed.
• Commissioners are allowed to request for line art upfront however if applicable.

Cancellation and Refunds

We reserve the right to cancel your commission or adoptable purchase for any reason at any time

• In the case of a cancellation on our end, 
• You will be issued a refund excluding fees
• or refund equal to the amount of work done prior to cancellation.
• In the case of buyer breaking our TOS and Rules,
• We have the right to take back what was purchase and resell it as a premade without refunding the buyer for breaching contract (this is applicable to both commission and adoptables)
  (   For clarification, takeback policy does not apply to valid purchases under our TOS. Takeback policy is applicable to certain circumstances of chargeback, scamming, minting/NFT, etc )
  
  
• Buyer will be blacklisted and unable to purchase any of our adoptables or commissions
  

Rights and Distribution

We retain the rights of distribution to the completed image, and have the right to...

• Display it in one or all of our online galleries
• Display it on this website as an example
• Display it to promote our commissions and adoptables
• Dictate where it can be posted if necessary

But will not...

• Reproduce and sell for additional profit.

Once you've received your completed commission, you may...

• display publicly in a personal gallery or website layout
  
• crop for personal use in an icon or banner or website
  
• use for non-commercial purposes (personal use)
  
• display in a character reference (and overlay text for such purposes, if necessary)

Once you've received your adopt, you may...

• display publicly in a personal gallery or website layout
  
• crop for personal use in an icon or banner or website
  
• use for non-commercial purposes (personal use)
  
• display in a character reference (and overlay text for such purposes, if necessary)
• redesign/ modify after adopt but it would be nice if you kept it recognizable.
  
• gift, or trade after adopt, but you must note me who is the new owner.
  
•  Owner must be explicitly clear that they are gifting or trading.
    Trading or Gifting with misleading or vague word terminology that goes against our TOS may not be allowed as it can be associated with scamming in transaction and/or breaking our TOS. 
  (ie. "Trading for Money "; "Selling for Art"; "Gifting for Currency"; or similar variations is not allowed. )
•    Failure to directly notify us of new owner transfership can result in blacklist. (Toyhouse does not notify us transferships)
• resell a custom adoptable for the same price but not higher than the price you bought it.
• commission other artists to draw your adopt.

But may NOT...

• remove or obscure our signature or place own label over ours if it can be misinterpreted as your ownership of the artwork
  
• display anywhere without appropriate credit when applicable (a simple '  by rumcandyadopt.deviantart.com ' or if on toyhouse, crediting our account rumcandy is preferred )
• reproduce and sell for an additional profit  
•  mint & sell & use of adopt/custom/commissions/art/our work in or usage on any blockchain-related technology such as NFT, crypoart, cryptocurrency, etc. 
  We forbid any reproduction of our work on any blockchain-related endeavors.
•  use of our artwork in any AI/ML technology such as but not limited to midjourney, daile2, mimic, etc
  We forbid any reproduction of our work on any AI/ML technology endeavors.
• claim the adoptable artwork as your original design
• resell a premade adoptable or a commission (unless explicitly stated allowed otherwise).
• To clarify, the no resell premade rule was added to adopts created in March 2015 and onward to discourage rule breaking and scamming. If you have purchased an adopt before March 2015, your adopt may have a listed resell rule on the original adopt listing.
